Biller, Sachs, Zito & Lemoult Survives Motion to Dismiss Unfair Insurance Practices Complaint

In this decision, Judge Egington of the United States District Court denied Wausau Business Insurance Company’s (a wholly owned subsidiary of Liberty Mutual Insurance) motion to dismiss. Biller, Sachs, Zito & LeMoult alleged that Wausau engaged in a pattern of unfair insurance practices by refusing to provide coverage and undervaluing insureds’ claims. By citing five other lawsuits against Liberty Mutual’s subsidiaries, Biller, Sachs, Zito & LeMoult was able to show that the CUIPA and CUTPA claims were sufficiently alleged.
